Terms of Service

Effective 21 September 2026. Working draft; counsel review before the beta opens beyond the founding accounts.

These terms are an agreement between you and Duo ("Duo", "we", "us") and govern your use of the Duo service, including playwithduo.com, the Duo web app, and the Duo desktop app. By creating an account or using Duo, you agree to them and to the Content Policy. If you do not agree, please do not use Duo.

1. What Duo is

Duo provides AI companions: characters you create or discover, that you can talk with, call, and play games alongside. Characters are software. Their words are generated by machine-learning models. They are fiction: not statements by real people, not professional advice of any kind, and not a substitute for human relationships or for medical, legal, financial, or mental-health care. If you are in crisis, contact your local emergency services; in the United States, call or text 988.

2. Who may use Duo

You must be at least 18 years old to use Duo. We ask for your date of birth when you create an account, and we may close an account we reasonably believe belongs to a minor.

You are responsible for your account, for keeping your credentials secure, and for the accuracy of what you tell us, including your date of birth.

3. Beta

Duo is early software in a closed beta. Features may change, break, or be withdrawn, and the service may be unavailable at times. We will try to give notice of significant changes, but we cannot promise uninterrupted service during this period. Access to the beta is by invitation and may be withdrawn.

4. Your content and your characters

You own what you write and the characters you create. To run the service we need your permission to store, process, and display that content back to you, and, only if you choose to publish a character, to display that character to other people. That permission ends for new uses when you delete the content or your account.

Characters you publish must follow the Content Policy. We may unpublish or remove characters that do not.

5. Memory

Characters keep memories of your conversations; that is what makes them companions rather than a blank chat box. Those memories belong to you and are visible to you. You can pin them, forget them, or delete them at any time from inside the product. A memory you forget stops affecting conversation immediately, and deleted records are purged on a routine schedule.

Memory is scoped to you. If you talk to a character someone else published, what it learns about you stays yours. It is never shared with that character's author or with other users.

6. Acceptable use

You agree not to use Duo to:

• break the law, or help anyone else do so;
• produce, request, or solicit sexual content involving minors. This is prohibited absolutely, with no exception and no setting that changes it. Accounts are terminated and reports are made to the authorities where the law requires;
• harass, threaten, defame, or endanger real people;
• impersonate a real person, or create a character using a real person's name, likeness, or voice without their consent;
• generate content that sexualizes real people without consent, or that promotes self-harm, terrorism, or violent extremism;
• scrape, resell, or redistribute the service; reverse-engineer it; or probe, overload, or bypass its technical, security, or billing controls.

We may suspend or terminate accounts that break these rules, and may remove content that does. To report content or a character, email hello@playwithduo.com.

7. Plans, billing, cancellation, and refunds

Duo offers a free plan and paid plans. Each plan includes allowances the service measures: the free plan includes a one-time hour of voice and co-op play; paid plans include a monthly number of hours. Text messages do not count against any allowance.

Automatic renewal. Paid plans are billed in advance through our payment processor, Stripe, at the price shown at checkout, and renew automatically for the same period (monthly or yearly) until you cancel. By subscribing you authorize the recurring charge.

Cancellation. You can cancel at any time from Settings, through Manage subscription, or by emailing hello@playwithduo.com. Cancellation stops the next renewal; you keep access until the end of the period you have already paid for.

Refunds. Where the law gives you a right to a refund or a cooling-off period, that right applies and nothing here removes it. Outside that, payments are generally non-refundable, but if something has gone wrong, write to us and we will look at it in good faith.

Price changes. We may change prices or allowances. We will give at least 30 days' notice by email before a change affects an existing subscription, and you may cancel before it takes effect.

8. AI output

AI models are imperfect. Output can be inaccurate, inconsistent, or inappropriate despite our safeguards, and the same prompt may produce different results. Do not rely on anything a character says as fact or as advice. You are responsible for how you use what Duo produces.

9. Ending the agreement

You can stop using Duo and delete your account at any time from Settings. We may suspend or end your access if you break these terms, if we are required to by law, or if we discontinue the service. If we discontinue the service, we will give reasonable notice and a way to export your data.

10. Disclaimers and liability

Duo is provided "as is" and "as available". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, our total liability to you for any claim relating to Duo is limited to the greater of the amount you paid us in the twelve months before the claim, or US$100. We are not liable for indirect, incidental, or consequential losses. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

11. Copyright and removal requests

If you believe content on Duo infringes your copyright, or depicts you intimately without your consent, email hello@playwithduo.com with the content's location and enough detail to act on. We remove nonconsensual intimate imagery within 48 hours of a valid request and handle copyright notices under the DMCA.

12. Changes to these terms

We may update these terms. If a change is material, we will give notice, by email or in the product, before it takes effect. Continuing to use Duo after that means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the courts of California will have jurisdiction, except where the law of your country of residence gives you the right to bring proceedings locally, which this does not remove.
